Alternative Procedure Agreement (Australia)

Summary

One type of Indigenous Land Use Agreement (ILUA) meeting the requirements of ss 24DB-24DM of the Native Title Act 1993 (Cth).

Extended Definition

An Alternative Procedure Agreement can only be made where there is no registered native title body corporate (or bodies corporate) for the entire agreement area. However, there must be at least one registered native title body corporate or at least one representative Aboriginal/Torres Strait Islander body for part of the agreement area. The agreement must not provide for the extinguishment of any native title rights or interests.
