The Australian Customs Service Antenna Indigenous Land Use Agreement (the ILUA) allows Customs to construct, operate and maintain a radio communications tower at a site on Mer (Murray) Island for 25 years.
The native title holders, represented by the native title body corporate Mer Gedkem Le, agree that if any of these activities are found to be invalid, or have been in the past, they are validated by the terms of this ILUA.
The parties also agree that the 'non-extinguishment principle' applies, which means that any of the activities validated by this ILUA do not extinguish any native title rights that exist in the area. |
