The agreement covers all the land and waters included in the Macumba Pastoral Lease. It includes lands that fall within both the outer boundary of native title determination application SAD6010/98 Eringa (SC96/3) and outer boundary of native title determination application SAD6016/98 The Wangkangurru/Yarluyandi Native Title Claim (SC97/3). (The Macumba Pastoral Lease is Number 2528 recorded in Crown Lease Register Book Volume 1607 Folio 55).

Summary Information:
The Combined Mandingalbay Yidinji Gunggandji Yarrabah Blockholders Indigenous Land Use Agreement (ILUA) is a body corporate agreement between:

- State of South Australia (applicant);

- Irrwanyere Aboriginal Corporation RNTBC;

- Edie King, Ruth McKenzie, Howard Doolan, Dean Ah Chee and Marilyn Hull on behalf of the Eringa Native Title Claim Group SAD6010/1998 and Eringa #2 SAD6002/1999;

- Linda Crombie, Brenda Shields, Sharon Lucas, Haydyn Bromley and Arthur Ah Chee on behalf of the Wangkangurru/Yarluyandi Native Title Claim Group SAD6016/1998; and

- S. Kidman & Co.

The purpose of this ILUA is to recognise the non-native title interests of the Macumba Pastoral Lease.

Details of the Agreement

The ILUA extract is limited to details regarding the term of the ILUA and information regarding the right to negotiate provisions of the native title act.

Commencement

The ILUA commences on the date of registration, that is, 18 September 2012. The ILUA has a probabation period which ends on the second day of the year after the date of registration. The ILUA otherwise has an indefinate term.

Native Title Provisions

The Extract notes that there are no statements within the Agreement of the kind which are mentioned in 24EB(1) or 24EBA(1) or (4) of the Native Title Act 1993 (Cth), and so the consequences set out under these sections are not triggered by this agreement.

This means that the ILUA does not:

- provide consent for the doing of any acts by non-native title parties;

- effect the right of the native title parties to negotiate with non-native title parties proposing to undertake a future act; nor

- validate any previous future acts.

Native Title in the ILUA area

On 11 September 2008, the Federal Court recognised Native Title rights within the ILUA area. The Federal Court held that Native Title exists in relation to the entire area of the Witjira National Park. The consent determination confers non-exclusive rights to the native title holders for the use and occupation of the land, consistent with other rights and interests.
