The Batchelor Indigenous Land Use Agreement (ILUA) was agreed between: Gabriel Hazelbane, David George Yates, Katye Felice McGuiness and Ada Calma; the Northern Land Council; and the Northern Territory of Australia. The agreement area is about 10 sq km and comprises all land and waters within the Town of Batchelor. The purpose of the ILUA is to provide consent for a range of acts, whether or not they are 'future acts' regarding the extinguishment of all native title rights and interests in the land held by the Warai and Kungarakany Groups The Native title Representative Body for the area is the Northern Land Council.
Detailed Information:
Details of the Agreement: The agreement area is about 10 sq km and comprises all the land and waters within the Town of Batchelor. Commencement: The ILUA commenced on 24 March 2015 and was entered onto the Register of Indigenous Land Use Agreements on 5 May 2016. Native Title Provisions: The parties consent to the surrender of any native title rights and interests in the land held by the Warai and Kungarakany Groups. The parties intend this surrender to extinguish those native title rights and interests. The parties also agree to the validation of any acts done invalidly by the Northern Territory done prior to this ILUA. The right to negotiations provisions of the Native Title Act 1993 (Cth) do not apply to the surrender.
