Mount Isa Cemetery Indigenous Land Use Agreement (ILUA)

The Extract from the Register of Indigenous Land Use Agreements describes the area subject to this ILUA, per Schedule one of the agreement, as that part of Lot 95 on SP265806 within a line joining the points shown on sheet 2 of Schedule one.

Registered with the National Native Title Tribunal ('NNTT'). This is an authorised Body Corporate under the Native Title Act 1993 (Cth).

The Mount Isa Cemetery Indigenous Land Use Agreement (ILUA) was made under the provisions of the Native Title Act 1993 (Cth) between Mount Isa City Council and Kalkadoon Native Title Aboriginal Corporation RNTBC.

The agreement covers an area of about 5 ha, which is part of Lot 95 on Plan SP265806, in the vicinity of the intersection of Commercial and Engineering Roads, Mount Isa.

The purpose of the agreement is to allow for dealing with an area of land so that the Mt Isa City Council may hold it in trust for the purpose of a cemetery.

The Native Title Representative Body for this area is Queensland South Native Title Services Ltd.

Commencement

The Agreement commences on the day it is signed by all the parties.

Native Title Provisions:

Right to negotiate

The parties agree that the right to negotiate provisions of the National Native Title Act (1993) do not apply.

Future act provisions

The parties agree to the local government or third party doing certain acts that are necessary for excising an area of about 5.037 ha from Lot 73 on SP134707, and including that excised area into Lot 95 on SP1347070 which is a reserve for cemetery purposes.

This Agreement is located within the area of native title recognised by the Federal Court of Australia (FCA) in the proceeding Doyle & Ors on behalf of the Kalkadoon People #4 v State of Queensland (No 3) [2011] FCA 1466 (FCA File No.: QUD579/2005, NNTT File No.: QCD2011/007).
