Summary Information:

The Poruma Island Department of Home Affairs Indigenous Land Use Agreement (ILUA) was agreed, under the provisions of the Native Title Act 1993 (Cth), between the Commonwealth of Australia as represented by the Department of Home Affairs, the Porumalgal (Torres Strait Islander) (TSI) Corporation RNTBC and the Torres Strait Island Regional Council.

The purpose of the ILUA is to consent to the granting of a lease in the ILUA area.

The Native Title Representative Body for this area is the Torres Strait Regional Authority.

Details of the Agreement:

Commencement and Termination:

The ILUA is binding from the date when signed by all the parties. It has effect as an ILUA and in relation to the agreed acts from its registration date. It was registered on 22/11/2018.

The agreement will terminate on the 30/06/2026.

Native Title Provisions:

Right to negotiate:

The parties agree that the right to negotiate provisions of the Native Title Act 1993 (Cth) do not apply to the acts agreed to.

Future act provisions:

The parties agree to the granting of the lease, described in Schedule 5 of the ILUA, but not included in the Extract, provided that it expires on the 1 July 2026. The parties also agree to the doing of any other future acts which the lease authorises.

Native Title in the Agreement Area:

The ILUA area is within the area of the native title determination Poruma People v State of Queensland [2000] FCA 1066. (FCA file no.: QUD6087/1998, NNTT file no.: QCD2000/005).
