The Cloncurry Indigenous Land Use Agreement (the ILUA) provides the consent of the native title party to future acts for the purpose of infrastructure in the town of Cloncurry in central western Queensland. The extract from the Register of Indigenous Land Use Agreements does not specify the activities for which consent is given (these are identified in Schedules 2 & 3 within the agreement) although it does describe the area of land covered by the ILUA as including the following types of land:
-Aboriginal Land, being land subject to the ALA (Aboriginal Land Act) transfer;
-Council Land; and
-Land for the proposed extension of a road (Hart Street). This indicates that the schedules of the agreement provide consent for the transaction of land tenures to provide an area of land as Aboriginal Land under the Aboriginal Land Act 1991 (Qld); an area of land for council infrastructure and the extension of Hart St.
The native title party agrees to surrender its native title over the Council land identified in the agreement. |
