The Breakaways / Moon Plain Filming Agreement was made between Intrepid Pictures (the producer) and the Antakirinja Land Management Aboriginal Corporation (ALMAC). The producer sought authorisation from ALMAC for the exclusive and uninterrupted right to part produce the film “Pitch Black” at a proposed location within the Breakaways subject to the rights and interests of the traditional owners. The agreement sets out the conditions under which this is possible. Under the agreement, the producer will comply with the Aboriginal Heritage Act 1988 (SA) to conduct and comply with a work area heritage clearance survey at its expense, and to employ an Aboriginal Heritage Inspector to oversee the operation. The producer agrees to use its best endeavours to employ members of the local Coober Pedy Aboriginal community in the course of the filming operations; minimise the impact of its operations on the environment and to rehabilitate the area after completion; acknowledge in the credits that the film was made with the permission of ALMAC on behalf of the traditional owners; and compensate for the loss of use and enjoyment of the location during the period of filming. The agreement also establishes a Liaison Committee comprising three members of ALMAC, one member appointed by the producer and one authorised officer appointed by the District Council of Coober Pedy. The group’s function is to assist in the resolution of differences relating to the agreement as they arise. The producer further agrees to negotiate a Location Agreement with the District Council of Coober Pedy with respect to the Breakaways Reserve, and ALMAC will authorise filming operations on the specified areas in accordance with that Location Agreement. The rights agreed are not dependant on a finding of native title and ALMAC warrants that it represents all members of the claimant group.
