Summary Information:
The Mineral and Petroleum Resources Development Regulations, 2004 (South Africa) were published on 23 April 2004, pursuant to the regulatory making power contained in the Mineral and Petroleum Resources Development Act 2002 . Among other things, the Regulations prescribe that holders of resource extraction rights must develop and adhere to a ‘social and labour plan’ for their operations. This must include the mine’s plan to achieve 10% female and 40% ‘historically disadvantaged South African’ participation in management within five years of the granting of new mining rights or the conversion of old mining rights. The Regulations also prescribe matters relating to mineral and petroleum exploration, the issuing of mineral and petroleum rights and pollution control.
