The Butchulla Peoples (represented by the Gurang Land Council Aboriginal Corporation) have two native title claims in the Wide Bay region - QUD6140/98 'Butchulla People' and QUD16/06 'Butchulla Land & Sea Claim'. These claims concern land within the local government areas of the Councils and in which the Corporation has infrastructure and operational interests. The Councils and the Corporation are respondents to the Butchulla People Application and are applying to be joined as respondents to the Butchulla Land & Sea Claim Application.
Under the MOU, the parties agree to explore avenues for settling these native title claims. That is, the parties aim to reach agreement about how their respective interests in the region can be implemented, and thereby avoid litigation. To this end, the MOU establishes an approach to and procedure for mediation (which is to be conducted by the National Native Title Tribunal) and sets out the scope of negotiations between the parties. The possibility of negotiating an Indigenous Land Use Agreement (ILUA) is raised in the MOU (NNTT 2007; ABC News 2007; National Indigenous Times 2007).
