The Mer Island State School Indigenous Land Use Agreement (ILUA) was agreed between the State of Queensland (represented by the Department of Education and Training) and the Mer Gedkem Le (Torres Strait Islanders) Corporation RNTBC ICN 3282 on 5 July 2010.
Under this ILUA, the Mer Gedkem Le (Torres Strait Islanders) Corporation agrees to grant a lease to the State of Queensland for the purpose of operating and maintaining a school on the Agreement Area (Lease G in Lot 48 on TS 207, County of Torres).
The parties agree that the right to negotiate provisions in Subdivision P, Part 2, Division 3 of the Native Title Act 1993 (Cth) do not apply to the activities to be conducted on the Agreement Area.
The parties to the ILUA consent to the doing of the following acts during the term of the lease:
- the construction, operation and maintenance of a School by the State of Queensland on the Agreement Area; and
- the conduction of geotechnical investigations by the State of Queensland on the Agreement Area.
