The ILUA is located within the area subject to the Djaku-nde and Jangerie Jangerie peoples' native title claim, which has been registered in the Federal Court of Australia as proceeding QUD6009 of 2000. This area is situated east of Cracow, Taroom and Wandoan in central Queensland, near the Auburn Range. The ILUA area falls within the jurisdiction of the North Burnett Regional Council and the Western Downs Regional Council. The ILUA area is to be reduced to the area covered by an easement for all or part of the pipeline route for QGC Pty Ltd's Queensland Curtis LNG project, once that easement is registered under the Land Act 1994 (Qld).

The Djaku-nde & Jangerie Jangerie & Wakka Wakka People & QGC Pty Limited Indigenous Land Use Agreement (ILUA) was agreed between QGC Pty Limited and James Saltner and others on their own behalf and on behalf of the Djaku-nde and Jangerie Jangerie Peoples, and Cyril Couchy and others on thier own behalf and on behalf of the Wakka Wakka People. The purpose of the ILUA is to provide consent for a range of acts, whether or not they are "future acts", regarding the ILUA area.
Detailed Information:
This ILUA relates to QGC's proposed Queensland Curtis LNG Project, which consists of the development, construction, operation, maintainance and ultimate decommissioning of a gas pipeline network. More specifically, the Project may include the construction of an export pipeline joining the gas fields to QGC's LNG facility on Curtis Island, as well as a number of other works and operational activities connected to the pipeline. As part of this ILUA, the parties agree to the doing of the following acts within the ILUA area, whether or not they are future acts:
  • The grant of the right to confer, vary, extend or renew any authorisation, lease, license, permit, approval, certificate, consent, direction or notice that is required or desirable for the undertaking of the Project;
  • The construction, operation and maintenance of the Project, and the undertaking of any works that are either necessary or incidental to the Project; and
  • The decommissioning of the Project and the eventual rehabilitation of any land that is affected by the Project.
The parties also agree that the right to negotiate provisions in subdivision P of Division 3 of Part 2 of the Native Title Act 1993 (Cth) do not apply to this agreement.
