The Ergon Energy Corporation Limited and Iman People #2 Indigenous Land Use Agreement (ILUA) was agreed between Ergon Energy Corporation Limited and Patrick Silvestor, Kenny Waterton, Eve Fesl, Richard Doyle, Eddy Waddy, Graham Anderson, Arwa Waterton, Cynthia Kemp, Bradley Curtis, Dean Marie Dodd-Ugle, Heidi Ann-Marie Lawson, Stuart White, Jason Jarro and Bevan Tull on their own behalf and on behalf of the Iman People #2 QUD6162/1998.
The ILUA covers about 14,000 sq km about 75 km north-east of Roma.
The purpose of the ILUA is to provide consent for a range of acts regarding energy and infrastructure.
The Native Title Representative Body for the area is Queensland Native Title Services Ltd. |
Details of the Agreement: The agreement area covers about 14,000 sq km about 75 km north-east of Roma. Commencement: The ILUA is effective from its registration date (17 June 2016).
Native Title Provisions: The parties agree that the non-extinguishment principle applies. This means under s 24EB(3) of the Native Title Act 1993 (Cth), any activities done by Ergon Energy Corporation Ltd that are authorised by this ILUA and may be inconsistent with native title, those activities do not extinguish the native title, instead those native title rights and interest are revived when the activities finish.
