Summary Information:

The Rainbow Beach Ambulance Station Indigenous Land Use Agreement (ILUA) is between the Butchulla People and the State of Queensland acting through the Department of Health (on behalf of the Queensland Ambulance Service).

The purpose of the ILUA is to provide consent for agreed acts, including the surrender of the agreement area, for the purpose of government and community services.

The agreement area is lot 1 of plan CP817467, covering approximately 2558 sq meters on the corner of Carlo Road and Karoonda Court, Rainbow Beach.

Details of the Agreement:

The ILUA area covers 2558 sq metres, being Lot 1 on CP817467 on the corner of Carlo Road and Karoonda Court, Rainbow Beach.

Commencement: The ILUA commenced on 29 July 2016.

Native Title Provisions:

The parties agree that the right to negotiate provisions of the Native Title Act 1993 (Cth) do not apply. The parties also consent to the doing of certain agreed acts by non-native title parties and validate any acts done prior to the registration of this ILUA. These agreed acts include the surrender of the agreement area to the State, and the all actions and works necessary to the construction of an Ambulance center.

The parties have agreed to the extinguishment of native title rights and interests, meaning that under s 24EB(3) of the Native Title Act 1993 (Cth), the surrender of the agreement area permanently extinguishes the native title rights and interests in the area.

Native Title in the ILUA Area:

The ILUA area is within the Federal Court determination area of De Satge on behalf of the Butchulla People #2 v State of Queensland [2014] FCA 1132. (FCA File NO.:QUD287/2009, NNTT File No.: QCD2014/015).
