Commencement and Termination The ILUA is binding from the date on which it was signed by all the parties. It has effect as an ILUA, in relation to the agreed acts, from its registration on 8 October 2019. The ILUA will continue in operation until the lease over the ILUA area between the Boulia Shire Council and the Pita Pita Aboriginal Corporation expires, and the ILUA is removed from the Register of Indigenous Land Use Agreements.
Native Title Provisions Right to Negotiate The parties agree that the right to negotiate provisions of the Native Title Act 1993 (Cth) do not apply to the acts agreed to by the ILUA.
Extinguishment The parties agree to the surrender of all native title rights and interests in the ILUA area. In doing so, the native title rights and interests in these areas were permanently extinguished upon registration of this ILUA on 8 October 2019. Future act provisions The parties agree to the Pitta Pitta people surrendering their native title over the ILUA area under the terms of this ILUA.
Native Title in the Agreement Area The ILUA area is within the area of the native title determination Aplin on behalf of the Pitta Pitta People v State of Queensland [2012] FCA 882. (FCA file no.: QUD6025/1999, NNTT file no.: QCD2012/007).
