Summary Information:

The Widi People and Local Government Indigenous Land Use Agreement (ILUA) was agreed, under the provisions of the Native Title Act 1993 (Cth), between Isaac Regional Council & Mackay Regional Council, Widi Aboriginal Corporation and the Widi People of the Nebo Estate #1.

The purpose of the ILUA is for the Widi People consent for certain activities being conducted in the agreement area by the Local Government.

The Native Title Representative Body for this area is the North Queensland Land Council Native Title Representative Body Aboriginal Corporation.

Commencement:

The ILUA is binding from the execution date, which is the date signed by the last party.

Native Title Provisions:

Right to negotiate:

The parties agree that the right to negotiate provisions of the Native Title Act 1993 (Cth) do not apply to the 'future acts'.

Future act provisions:

The parties agree to the doing of certain acts, including:

- those which have a Low Native Title Impact;

High Native Title Impact activities where the local government has given notice to the Widi People, or their representative, in accordance with the requirements that have been set out in the ILUA. The requirements are not included in the Extract; and

- for High Native Title Impact activities which involve a capital work that is dealt with at a Capital Works Forum, the local government is to provide notice of the work and reach consensus about the work with the other parties.

Low Native Title Impact activities are those which are described in Schedule 7 attached below.

High Native Title Impact activities are those which are described in Schedule 8 attached below.

Native Title in the Agreement Area:

The ILUA area is within the area of the native title determination Pegler on behalf of the Widi People of the Nebo Estate #1 v State of Queensland (No 2) [2019] FCA 1159 (FCA file no.: QUD372/2006, NNTT file no.: QC2006/014).
