Details of the Agreement: Commencement: The ILUA is binding from the execution date, which is the date signed by the last party. Native Title Provisions: Right to negotiate: The parties agree that the right to negotiate provisions of the Native Title Act 1993 (Cth) do not apply to the 'future acts'. Future act provisions: The parties agree to the doing of certain acts, including: - those which have a Low Native Title Impact; - High Native Title Impact activities where the local government has given notice to the Widi People, or their representative, in accordance with the requirements that have been set out in the ILUA. The requirements are not included in the Extract; and
- for High Native Title Impact activities which involve a capital work that is dealt with at a Capital Works Forum, the local government is to provide notice of the work and reach consensus about the work with the other parties.
Low Native Title Impact activities are those which are described in Schedule 7 attached below. High Native Title Impact activities are those which are described in Schedule 8 attached below.
