The Yougro Indigenous Land Use Agreement (ILUA) was agreed, under the provisions of the Native Title Act 1993 (Cth), between: - the State of Queensland acting through the Department of Agriculture and Fisheries;
- Gemma Cronin, Shirley Blake and others on their own behalf and on behalf of the Butchulla People; and
- Yougro Pty Ltd.Â
The purpose of the ILUA is to provide the Butchulla People's consent to the ILUA area being redescribed as two new lots; one for the purpose of Yoogro's sales of landscaping supplies and another for unspecified purposes.
The Native Title Representative Body for this area is Queensland South Native Title Services Ltd. |
Details of the Agreement Commencement and Termination: Subject to clause 3.2 of the ILUA, which is not included in the Extract, the ILUA commences on the date when signed by all the parties. The agreement in relation to the future acts commences upon registration, 7 May 2019.
Native Title Provisions Right to negotiate The parties agree that the right to negotiate provisions of the Native Title Act 1993 (Cth) do not apply. Future act provisions The parties agree to the following acts, including any acts that may be done as part of or in relation to: - the original grant, renewal, variation, and the redescription of the ILUA area as the Sales Permit Lot and the Balance Lot: and
- the creation of Lot 1 on AP23253 (the Sales Permit Lot) for Yoogro's quarry materials; and
- the creation of Lot 138 on AP23253 (the Balance Lot) after the redescription of the ILUA area. This Lot is shown on Schedule 3 of the ILUA (see attached under documents below); and
- the validation of any of these above acts, if they were invalidly done in conflict with native title rights and interests, prior to the registration date.
Native Title in the Area The Butchulla People do not have an active native title determination application within the ILUA area.
