This is a framework ILUA under which the parties consent to the grant of authorised exploration tenements and the carrying out of authorised exploration activities under them.
The ILUA, which was signed in November 2005, commences on the commencement date and continues until the expiration of the exploration contracts entered into under the ILUA, subject to review every five years. |

The parties agree that the non-extinguishment principle applies to the grant of the authorised exploration tenements and the carrying out of authorised exploration activities under the authorised exploration tenements. This means that under section 24EB(3) of the Native Title Act 1993 (Cth) those activities authorised under this agreement which may be inconsistent with native title rights and interests do not extinguish these interests, instead they are revived when the activities are finished.
The parties agree that the right to negotiate provisions of the Native Title Act 1993 (Cth) are not intended to apply to the grant of authorised exploration tenements or the carrying out of authorised exploration activities under the authorised exploration tenements. | |
