Under the Ewamian and Teck Cominco Australia Minerals Pty Ltd Indigenous Land Use Agreement the native title party, the Ewamian People, consent to the grant of two Exploration Permits for Minerals (EPM 12934 and EPM 13072) to Teck Cominco by the State of Queensland.
Neither the future act and right to negotiate provisions of the Native Title Act 1993 (Cth) nor the Mineral Resources Development Act 1989 (Qld) apply to these grants. The ILUA is substituted for the rights that would be afforded to registered native title claimants under those provisions.
The extract of the ILUA from the Register of Indigenous Land Use Agreements does not specify any conditions to the grant of the EPMs, although these may be contained within the agreement. |
