| The areas covered by the Agreement are located about 75 km west of Clermont and collectively cover an area of about 2,579 sq km. The Agreement area comprises the following Exploration Permit Applications - EPM12045, EPM12047, EPM12234, EPM13001, EPM13002 and EPM13044 and fall within the Shires of Belyando and Jericho. |

The Kangoulu People and AusQuest Limited Indigenous Land Use Agreement (the ILUA) provides the consent of the native title party - the Kangoulu People - to the grant of seven Exploration Permits (EPs). The ILUA also specifically notes that the Cultural Record (Landscapes Queensland and Queensland Estate) Act 1987 (Qld) applies and is not limited by the ILUA.
Without this consent, the grant of the permits would have been invalid and the right to negotiate provisions of the Native Title Act 1993 (Cth) (NTA) would apply. Under the NTA any activity that may affect native title rights, such as the grant of an EP, is defined as a 'future act' and must comply with the future act provisions of the Act in order to be valid. |
