Summary Information:
The Winton ILUA - Maiawali and Karuwali People Indigenous Land Use Agreement facilitates the granting of mining tenements to opal miners in an area near Winton in central Queensland.

Rather than going through the right to negotiate provisions of the Native Title Act 1993 (Cth), under the agreement Prospecting Permits, Exploration Permits, Mining Claims and Mining Leases can be granted to opal miners between 2001 to 2011 subject to conditions specified in the agreement. Conditions include:
- payment by the grantee of an amount for each tenement granted;
- limited timeframes for each type of tenement granted, being 3 months for Prospecting Permits, 12 months for Exploration Permits, 5 years for Mining Claims and 10 years for Mining Leases; and
- specified size limitations for the tenements (except Prospecting Permits).

Mining Claims and Leases may be renewed as long as they remain subject to the specified conditions.
Outcomes:
A proceeding in the Queensland Land and Resources Tribunal regarding an application for Mining Lease No. 95482 within the area of the Winton ILUA, recommended that the lease be granted in compliance with the terms of the ILUA. (See the Online Resources section for a link to this decision).
