The Agreement area covers the extent of the pipeline corridor which commences near Birregurra and traverses south westerly to the UGS facility at Iona then to Paaratte then to both Fenton Creek and Mylor. The corridor is 20 metres wide in parts and 40 metres wide in other parts and covers an area of about 1.691 sq kms. The area falls within the Colac Otway and Corangamite Shires.
Legal Status: Registered with the National Native Title Tribunal on the Register of Indigenous Land Use Agreements on 25 January 2002. This is an authorised Area Agreement under the Native Title Act 1993 (Cth).

Summary Information:
The Birregurra - Paaratte Pipeline Indigenous Land Use Agreement (the ILUA) enables the section of a gas transmission pipeline to be built from Birregurra to Paaratte, in south west Victoria.

The native title parties consent to the grant of a permit to own and use the pipeline and a licence to construct and operate the pipeline by the State of Victoria to GPU Gas Net and Transmission Pipelines Australia. This includes all 'leases, easements, licences or other authorities to construct, operate, inspect, maintain or repair' and any 'other titles or permits required' for operations in the pipeline area. The ILUA also covers the necessary 'consents or authorities' for the construction and operation of the 'gathering lines' to the adjoining pipeline sections. These are located from Iona to Paaratte, Paaratte to Fenton Creek and Fenton Creek to Mylor. All of these grants may be re-newed (in line with the relevant legislation).

The parties agree that the right to negotiate provisions of the Native Title Act 1993 (Cth) do not apply to any of the activities covered by the ILUA.
