Under the Carapooee West Dam Indigenous Land Use Agreement the Dja Dja Wurrung native title group consent to the construction of a dam.
The construction of the dam requires the grant of a crown licence by the State, which would be classed as a future act and subject to the right to negotiate provisions under the Native Title Act 1993 (Cth), if this agreement had not been reached. The Dja Dja Wurrung also consent to any other future acts that are necessary to construct and maintain the dam and agree to validate any future acts relating to the dam that may have been carried out prior to the registration of the ILUA. |
