The Twofold Bay Indigenous Land Use Agreement (the ILUA) enables a joint project by the New South Wales (NSW) and Commonwealth governments on land and waters in and around Twofold Bay in south east NSW. The project includes construction and operation of a wharf & jetty, commercial and armaments storage areas, an aquaculture facility and access roads. In the Agreement, the Twofold Bay Native Title Group consents to any future acts that are 'necessary or convenient' for: - the 'construction, maintenance and use' of a wharf and jetty, aquaculture facility and an Armaments Storage Area; - construction, use and change of status of roads in the area; and - dredging of a wharf and jetty perimeter and turning basin. This includes consent to grant any licence, easement, lease, operation agreement, occupation permit or development approval required for these activities. The group consents to the compulsory acquisition of the land required for these activities of the project, under the terms of the relevant State and Commonwealth legislation. In relation to land for the Commercial Storage Area, the group consents to a compulsory acquisition of the land being done under the terms of section 24MD of the Native Title Act 1993 (Cth). |
