The area of the ILUA covers the area of Exploration Licence applications 22645, 22749, 22750 and 22751, which cover parts of the Kirkimbie, Bunda, Wallamunga and Birrindudu Perpetual Pastoral Leases ( PPL No.s 1084, 1027, 1029 and 1012 respectively). The area is 5354.1 sq kms in size and is located across the Buchanan Highway in the Northern Territory, bordering with Western Australia. It is not within any incorporated local government region. It is within the Garrak-Jarru ATSIC region. | ||

The Ausquest Limited / CLC No. 2 (within Kirkimbie, Bunda, Wallamunga and Birrindudu PPL's) Indigenous Land Use Agreement (the ILUA) allows exploration for minerals by the company Ausquest, in line with the Exploration Licences (ELs) they have been granted over an area south-southeast of Kununurra. The ILUA enables four EL applications to be granted and validates any future exploration activity in the area. Without this ILUA, the grant of the ELs may have attracted the right to negotiate and been subject to the future act provisions of the Native Title Act 1993 (Cth) or may have been granted invalidly. The native title holders are represented by the Central Land Council in this ILUA. Their consent to the exploration is given subject to conditions. The ILUA includes conditional provisions regarding: 'procedures to minimise the environmental impact of exploration and to promote the rehabilitation of any part of the Area which has been subjected to exploration;' 'the protection of any native title rights and interests, including the protection of sacred sites;' and compensation. The full terms and conditions of the ILUA are not specified in the extract from the Register of Indigenous Land Use Agreements. |
