The Ariadne Indigenous Land Use Agreement (ILUA) allows for infrastructure and commercial development in the Mariner's Cove marina area of the Gold Coast by the company Ariadne Australia.
The Parties to the ILUA agree to all grants, leases 'permissions, licences, permits, authorisations, approvals, grants of tenure [...], rearrangement of existing property boundaries and any works (including Public Works)' required for the development project. The project includes 'all buildings, jetties, marinas, wharves, structures, works, (including Public Works demolition, reclamation and dredging works), uses and activities' in the area of the already existing Mariner's Cove marina and 'Public Works' in the new ILUA area. The non-extinguishment principle applies to leases in the new area - this means that the granting of leases will not extinguish any native title rights and interests that may exist in the area. However the ILUA also refers to the notion that previous leases in the area may have validly extinguished native title. |
