The ILUA area is located approximately 15 kilometres south-east of Theodore and 80 kilmetres south-west of Biloela in central Queensland. Summary Information:
The Cracow Project Indigenous Land Use Agreement (ILUA) allows for a mining project to proceed in central Queensland. Three mining tenements are granted to Newcrest Mining Limited on behalf of a joint venture of four companies.

The native title parties of the area also consent to the grant of future applications over the area for exploration or mining tenements and any other title, tenure, approval or proposal required for the mining project.

Granting of tenements is defined as a future act and without the ILUA would be subject to the right to negotiate provisions of the Native Title Act 1993 (Cth) - the ILUA specifies that these provisions do not apply in relation to the grant of these mining tenements nor any of the future applications.

Parties consent to the grants 'provided that at the time of the grants there is no Outstanding Breach' by the companies - this indicates that the grants are approved subject to a set of conditions.
