The area of the ILUA covers approximately 1495 sq kms and is located in several sections around the vicinity of Mount Surprise, inland from Townsville in north east Queensland. The area comprises those parts of Exploration Permits EPM12535, EPM11709, EPM12510, EPM12475, EPM 13055 and EPM 13191 that are within the boundaries of the Ewamian People #2 and #3 native title claims (determination application National Native Title Tribunal File Nos: QC99/13 and QC01/16). The ILUA is within the Dalrymple and Etheridge Shire Councils.

    Summary Information:
    In the Ewamian People Exploration Permit Backlog Project #2 Indigenous Land Use Agreement (ILUA), the Ewamian People have agreed to the grant of Exploration Permits (EPs) and Mineral Development Licences (MDLs) by the State of Queensland. The right to negotiate provisions of the Native Title Act 1993 (Cth) do not apply to these grants. This will enable the backlog of applications for tenements in the agreement area, made to the State by grantees, to be processed without requiring the longer timeframes of the right to negotiate process that would otherwise apply.

    EPs and MDLs may be granted to an 'Explorer' subject to conditions specified in the agreement. On being granted a tenement, the grantees may conduct 'Exploration Activities' in the area, in line with the conditions.

    EPs and MDLs granted under the ILUA may be renewed, provided they remain subject to the conditions of the agreement and the grantee has paid a compensation amount to the 'Native Title Group' specified in the agreement.
