Summary Information:
The Akaitcho/Tlicho Boundary Agreement is made between The Tlicho First Nation, represented by the Dogrib Treaty 11 Council and the Yellowknives Dene First Nation (Dettah), Yellowknives Dene First Nation (Ndilo), Lutsel K'e First Nation and Deninu Kue First Nation, represented by the NWT Treaty 8 Tribal Corporation (Akaitcho Territory Dene First Nations).

In 1994 negotiations commenced between the Dogrib in the North Slave region and the Governments of Canada and the Northwest Territories for a North Slave Agreement. This eventuated in the Tlicho Land Claims and Self-Government Agreement of 2003 made pursuant to the Dogrib Agreement-in-Principle. However, in 1994, Treaty 8 Dene in two communities near the town of Yellowknife decided not to participate in the Dogrib negotiations and instead aligned themselves with other Treaty 8 Dene people. This decision led to a boundary/overlap issue between the Treaty 11 Dogrib and the Treaty 8 Dene.
The historic Akaitcho/Tlicho Overlap Agreement was signed in October 2002.
Detailed Information:
The Akaitcho/Tlicho Boundary Agreement (Boundary Agreement) acknowledges that, in October 2002 when the Boundary Agreement was signed:
  • the Tlicho First Nation was completing the negotiations for the Tlicho Land Claims and Self-Government Agreement (Tlicho Agreement) with the Governments of Canada and the Northwest Territories;
  • The Akaitcho Territory Dene First Nations were negotiating with the same governments pursuant to a Framework Agreement of July 2000 (Akaitcho Agreement);
  • The Tlicho First Nation and the Akaitcho Territory Dene First Nations had overlapping land and resource interests; and
  • It was desired to resolve the issues of overlap in 'a spirit of traditional respect and co-operation' and to the parties' mutual benefit.

    The Boundary Agreement provides for:
  • The exercise of Tlicho First Nation harvesting rights outside the Tlicho Primary Use Area (indicated on the map attached to the Boundary Agreement (the map));
  • The exercise of Akaitcho Territory Dene First Nations' harvesting rights outside of their Primary Use Area (indicated on the map);
  • The delineation of the Parties' Shared Primary Use Area (delineated on the map);
  • The delineation in the Tlicho Land Claims and Self-Government Agreement of the Tlicho area of Wek'eezhii (shown on the map);
  • The parties to the Agreement entering into an interim agreement to govern their shared decision making within the Shared Primary Use Area until the Akaitcho Agreement takes effect and the Tlicho Agreement is amended;
  • The provision of a permanent Shared Primary Use Area Agreement;
  • Both the Akaitcho and Tlicho Agreements to be consistent with the Boundary Agreement;
  • Both parties agreeing to consult with the other in relation to decisions regarding land and resources that will affect the interests of the other party;
  • The agreement by both parties, when exercising their authority in relation to management or regulation of lands or resources, to
    - 'Work co-operatively to protect their respective and mutual interests;
    - 'Foster sustainable development and the protection of lands, resources and harvesting opportunities for present and future generations;
    - 'take steps to acquire and use traditional knowledge as well as other types of scientific knowledge and expert opinion.'
