| The Agreement Area is located over the area of Exploration Permit 93 in respect to (a) certain pastoral Land under Perpetual Pastoral Lease 1104 and (b) Vacant Crown Land NTP4207, other than the part of the Permit Area that relates to Aboriginal land held by the Land Trust under the Land Rights Act. The ILUA is not within any incorporated local government areas. It is within the Central Remote ATSIC region. |

| The Exploration Permit 93 Indigenous Land Use Agreement validates the grant of EP93 to Merlin Energy Pty Ltd. The Central Land Council (CLC) represents the native title party in this ILUA. Without the native title party's approval, the grant of EP93 would require the parties to undergo the right to negotiate process of the Native Title Act 1993 (Cth). An 'Exploration Deed' detailing the conditions of the approval for grant of the EP is attached to the ILUA. The ILUA specifies that the non-extinguishment principle applies to the acts covered by the agreement, which means that activities done under EP93 do not extinguish native title. The ILUA does not include the grant of a production licence following exploration of the area. |
