Summary Information:
The Implementation Plan for the Gwich'in Comprehensive Land Claim Agreement exists as between the Gwich'in Tribal Land Council (representing themselves and the Gwich'in people of the Mackenzie Delta), the Government of the Northwest Territories, and the Government of Canada. Chapter 28 of the Gwich'in Comprehensive Land Claim Agreement (the Gwich'in Agreement) states that the Implementation Plan is to operate for a minimum period of 10 years for the purposes of overseeing and directing the implementation of the Gwich'in Agreement, and is to set out the obligations and activities of each of the parties to that Agreement. The Implementation Plan does not create legal obligations beyond those contained in the Gwich'in Agreement.
Detailed Information:
The Implementation Plan takes effect when the Gwich'in Agreement comes into operation on the passing of relevant legislative provisions arising from the terms of the Agreement.

The Implementation Plan identifies the following:

  • The obligations and activities required to implement the Gwich'in Agreement;
  • An estimation of the costs associated with the implementation of the Agreement;
  • The party responsible for each particular obligation or activity;
  • The manner in which activities are to be carried out;
  • The time frame in which activities are to be carried out;
  • Any regulatory or legislative amendments necessary to carry out the activities;
  • Responsibility for funding the activities;
  • Training and economic opportunities for the Gwich'in people of the Mackenzie Delta;
  • The obligations, activities, time frames and funding are detailed extensively in Activity Sheets which are annexed to the Implementation Plan (Annexures A-B);
  • Financial and funding aspects of the activities, and the Communication and Information Strategy are also annexed to the Implementation Plan (Annexures C-D);
  • Chapter 28 of the Gwich'in Agreement establishes an Implementation Committee which is to 'guide the implementation of this agreement.' The Committee is made up of one representative each from the Gwich'in Tribal Land Council, the Government of the Northwest Territories and the Government of Canada. The Committee is to monitor the status of the Implementation Plan, revise activities schedules and funding allocation as necessary, resolve disputes between the parties to the Implementation Plan, determine whether obligations have been fulfilled, provide annual reports and make recommendations. The details of the Implementation Committee are set out in Annex E.
