The Akaitcho Treaty 8 Framework Agreement (the Framework Agreement) was signed by the Northwest Territories Treaty 8 Tribal Corporation (representing the Akaitcho First Nations), the Government of the Northwest Territories and the Government of Canada on 25 July 2000. This date is the centenary anniversary of Treaty 8 concluded in 1900 by the Akaitcho Chiefs from Welecheh (North Slave), Tahche (East Arm) and Deh Chah (South Slave) and the Crown. The Framework Agreement reconfirms the Parties' commitment to Treaty 8, some provisions of which were not implemented. The governments have agreed to resolve outstanding land, resource and governance issues via the process of negotiation. The Framework Agreement is the first stage of the negotiation process which defines the subject matters, process and timetable for reaching an Agreement-in-Principle.
Detailed Information:
The Framework Agreement recognises the 'importance of negotiating with Aboriginal Peoples [and] respecting their rights to land and resources'. It reaffirms existing Aboriginal, treaty and self-government rights of the Aboriginal peoples of Canada under section 35 of the Constitution Act, 1982. The purpose of the Framework Agreement is to guide the negotiation of the Agreement-in-Principle (AIP) which will in turn establish the schedule and process for the Akaitcho Agreement. The objective of the negotiations is to complete the Akaitcho Agreement which will contain governance arrangements and land and resources provisions. The subject matters for negotiation include:

  • Economic measures;
  • Financial payments and transfer arrangements;
  • Resources revenue sharing;
  • Lands and waters;
  • Wildlife harvesting;
  • Boundary and overlap issues of Akaitcho territory;
  • Parks and conservation areas;
  • Governance;
  • Administration of justice;
  • Education, health and housing;
  • Public works;
  • Taxation; and
  • Review, amendment and implementation.

    The Framework Agreement constitutes a commitment by all Parties to negotiate in good faith with the intention of reaching an agreement. The Framework Agreement also establishes a schedule to complete the Akaitcho AIP no later than 36 months after the approval by the Parties of the Framework Agreement. A negotiation process is set out in detail along with an approval process for the AIP and the Akaitcho Agreement. Information regarding the status, aims, objectives and progress of the negotiations is to be made available to the public. Canada is to provide funding for the negotiation of the AIP and the Akaitcho Agreement. Any amendments may be made with the written consent of the parties.
