The ILUA is between Gary Hudson and others on their own behalf and on behalf of the Kowanyama Native Title Group and Elrose Enterprises Pty Ltd, a pastoral company.
The ILUA provides that:
'The Native Title Parties consent to the Fodder Cropping Operation by the Pastoralist and any application by the Pastoralist to any lease, license or permit for a term of no more than 20 years as may be required to undertake a Fodder Cropping Operation'.
'Fodder Cropping Operation' is defined in the ILUA as involving the 'growing and harvesting of forage sorghum or improved pasture in the designated. . . Area including planting, irrigating, mowing and finally curing prior to bailing for the purpose of feeding cattle'. |
