The Memorandum of Understanding (MoU) was made between the Government of Australia and the United Nations Transitional Administration in East Timor (UNTAET), acting on behalf of East Timor. The MoU concerns arrangements relating to the Timor Gap Treaty, of 11 December 1989, and was made pursuant to the Agreement between the Government of Australia and UNTAET contained in the exchange of letters of 10 February 2000.
The MoU, which applied from the 25 October 1999 (the date that Indonesia withdrew from East Timor) confirms that UNTAET 'will exercise its rights and obligations under the Treaty in close consultation and cooperation with representatives of the East Timorese people.'
The MoU was to continue in force until until East Timor gained its independence (May 2002).
The MoU states that all laws, rules, regulations etc. in force prior to 25 October 1999, 'to the extent necessary to give effect to the Treaty, will continue to apply'. Under the MoU UNTAET was to designate its own representatives on the Ministerial Council and the Joint Authority set up under the Treaty. |
