The Baronta Park Indigenous Land Use Agreement (ILUA) deals with access, cultural heritage and the status of the pastoral lease at the grazing property 'Baronta Park'. The ILUA details the consent of the parties to certain 'future acts'. The most significant of these is the upgrade of Special Lease No. 23/39912 to a Perpetual Lease for grazing purposes. The ILUA provides consent for State and local government actions made in connection with the upgrade of the Lease. This could include making decisions or recommendations, issuing licences, approving programs or granting permissions. The grant of any other necessary license, permits, authorities or approvals in connection with upgrading the lease is also consented to in the ILUA. The parties agree that the right to negotiate provisions of the Native Title Act 1993 (Cth) do not apply, as the alternative consultation provisions are to be followed instead. Without this agreement, upgrading of the lease would have been invalid and the right to negotiate provisions of the Native Title Act 1993 (Cth) would apply. Under this act any activity, such as a grant of land, that may affect native title rights is defined as a 'future act' and must comply with the future act provisions of the act in order to be valid. |
