The Fishing Indigenous Land Use Area Agreement Template was developed by Aboriginal Legal Rights Movement Inc, Seafood Council SA, South Australian Fishing Industry Council and the Government of South Australia. The ILUA template 'provides a framework for specific negotiations with native title parties across the State. This process ensures that participants are prepared and adequately resourced for the negotiation and the template is based on what has worked for other groups and is modified to reflect local diversities' (South Australian Indigenous Land Use Agreement (ILUA) Statewide Negotiations Strategic Plan 2006-2009, p.6). The template contains numerous clauses relating to rights over the aquatic resources of the water, as well as a suggested recognition statement which acknowledges the specified Traditional Owner group as the owner of the sea resources in the ILUA area. Detailed Information:
The South Australian Government, through the South Australian Indigenous Land Use Agreement (ILUA) Statewide Negotiations Strategic Plan 2006-2009 is committed to achieving its stated objective of achieving 'certainty over access to and sustainable use of land, water and resources through negotiated recognition and just settlement leading to the resolution of native title claims across the State.' In order to further this aim, they have developed five template Indigenous Land Use Agreements relating to: Fishing and aquaculture; Local government; Minerals exploration; Outback areas; and Pastoral.
