Summary Information:
The Pastoral Indigenous Land Use Agreement Template was developed by the Aboriginal Legal Rights Movement Inc, the South Australian Farmers Federation Inc and the Government of South Australia in order to 'assist voluntary negotiations between pastoral lessees, native title claims groups and the State.' The ILUA template 'provides a framework for specific negotiations with native title parties across the State. This process ensures that participants are prepared and adequately resourced for the negotiation and the template is based on what has worked for other groups and is modified to reflect local diversities' (South Australian Indigenous Land Use Agreement (ILUA) Statewide Negotiations Strategic Plan 2006-2009, p.6). The template contains numerous clauses relating to pastoral leases, including validating the pastoral lease in the ILUA area, and stipulating that, subject to the agreement, the Native Title Claim Group has the right to conduct traditional activities on the ILUA area. The template also details arrangements relating to the use of tracks and vehicles; camping; burials; dispute resolution; and the application of the Native Title Act 1993 (Cth). Detailed Information:
The South Australian Government, through the South Australian Indigenous Land Use Agreement (ILUA) Statewide Negotiations Strategic Plan 2006-2009 is committed to achieving its stated objective of achieving 'certainty over access to and sustainable use of land, water and resources through negotiated recognition and just settlement leading to the resolution of native title claims across the State.' In order to further this aim, they have developed five template Indigenous Land Use Agreements relating to: Fishing and aquaculture; Local government; Minerals exploration; Outback areas; and Pastoral.
