Summary Information:
The Outback Areas Indigenous Land Use Agreement Template (ILUA) was developed by the Aboriginal Legal Rights Movement Inc and the Government of South Australia. This template is designed to be used to negotiate an ILUA between a Traditional Owner group and a local township. The ILUA template 'provides a framework for specific negotiations with native title parties across the State. This process ensures that participants are prepared and adequately resourced for the negotiation and the template is based on what has worked for other groups and is modified to reflect local diversities' (South Australian Indigenous Land Use Agreement (ILUA) Statewide Negotiations Strategic Plan 2006-2009, p.6). The template contains numerous clauses that set out matters including: Native Title Act 1993 (Cth) statements; Requirements of heritage surveys; Acknowledgment that compensation is final, and that any compensation received is for the benefit of all people in the Traditional Owner group; The rules, role and membership of a Liaison Committee; and The benefits that may be included in an ILUA, such as the provision of specialised training, education or a building. Detailed Information:
The South Australian Government, through the South Australian Indigenous Land Use Agreement (ILUA) Statewide Negotiations Strategic Plan 2006-2009 is committed to achieving its stated objective of achieving 'certainty over access to and sustainable use of land, water and resources through negotiated recognition and just settlement leading to the resolution of native title claims across the State.' In order to further this aim, they have developed five template Indigenous Land Use Agreements relating to: Fishing and aquaculture; Local government; Minerals exploration; Outback areas; and Pastoral.
