The Pastoral Lease Grant Agreement is a template Future Act Agreement provided by the National Native Title Tribunal (NNTT). It is envisaged by the NNTT that these agreements will be used to assist Indigenous and non-Indigenous Australians to negotiate Future Act Agreements that can be tailored to their specific needs and circumstances. The Pastoral Lease Grant Agreement is designed to be used for negotiations between the Minister for the Environment and Natural Resources (or its equivalent) and Aboriginal Communities. This template agreement is based on the South Australian legislative regime. It may be entered into whether or not native title has been determined or found. The template agreement covers matters including: (a) stipulating that the granting of a pastoral lease would not extinguish any Traditional Rights in or to the Land; (b) allowing the conduct of pastoral activities, and stipulating that pastoralists would have the right of exclusive possession on any land within a one kilometre radius of any house, shed, outbuilding or other building erected on the Land; (c) the manner in which traditional rights can be exercised on the pastoral lease; and (d) the protection of Aboriginal cultural sites and objects. | ||
