The Withdrawal - Infrastructure Agreement is a template Mediation Withdrawal Agreement provided by the National Native Title Tribunal (NNTT). It is envisaged by the NNTT that these agreements will be used to assist Indigenous Australians and non-Indigenous Australians to negotiate Mediation Withdrawal Agreement that can be tailored to their specific needs and circumstances. The Withdrawal - Infrastructure Agreement is designed to be made between a registered native title party and a company that is a respondent party to a native title claim. The agreement would see the company withdraw from the native title claim in return for certain commitments from the native title party. These commitments would be that, notwithstanding the eventual outcome of the native title claim, the native title party would agree that they will not prejudice the company's rights and interest in the claimed area, whether by political, legal or other means. The template agreement also sets out other matters, including confidentiality requirements. | ||
