| The Withdrawal - Mining Agreement is a template Mediation Withdrawal Agreement provided by the National Native Title Tribunal (NNTT). It is envisaged by the NNTT that these agreements will be used to assist Indigenous Australians and non-Indigenous Australians to negotiate Mediation Withdrawal Agreement that can be tailored to their specific needs and circumstances. The Withdrawal - Infrastructure Agreement is designed to be made between a registered native title party and a mining company that is a respondent party to a native title claim. The Agreement would see the mining company withdraw from the native title claim in return for certain commitments from the native title party. These commitments would include that, notwithstanding the eventual outcome of the native title claim, the native title party would agree that they would not prejudice the mining company's rights and interests in the claimed area, whether by political, legal or direct means. The template agreement also sets out other matters, including confidentiality requirements. | ||
