The Claims Negotiating Framework - NTA is a template Negotiating Framework Agreement provided by the National Native Title Tribunal (NNTT). It is envisaged by the NNTT that these agreements will be used to assist Indigenous Australians and non-Indigenous Australians to negotiate Negotiating Framework Agreements that can be tailored to their specific needs and circumstances. The Claims Negotiating Framework - NTA is designed to be made between native title claimants and a State or Territory, and aims to provide a basis, process and timetable for negotiating a native title claim without the need for a Federal Court proceeding. The template agreement covers matters including: (a) negotiations will be based on the premise that a determination of native title is possible; (b) any agreement as to native title would be subject to the laws of the State or Territory and the Commonwealth, and to any other private rights and interests; (c) the statements that each party would provide to the other before negotiations commenced, including that the native title party would have to a statement detailing the extent of the native title that was being claimed; and (d) dispute resolution procedures. | ||
