There were two stated objectives of the Agreement. The first objective for the Pedersens was to provide them with increased security of tenure, by way of a perpetual lease over their pastoral property. The second objective for the Western Yalanji was to facilitate the recognition of Western Yalanji native title rights and interests in Areas A, B, C and D and to enable the Western Yalanji to obtain a perpetual lease.
The agreement also sets out the initial intention that the Pedersens be granted a perpetual lease over Area B under the Land Act 1994 (Qld) (for grazing and agriculture and associated Primary Production Activity Purposes as defined in the Native Title Act 1993(Cth). In addition it was intended that the Western Yalanji Aboriginal Corporation obtain a perpetual lease over Area A under the Land Act 1994 (Qld), and the Western Yalanji obtain freehold title to Area A under the Aboriginal Land Act 1991 (Qld). Ultimately the intention was to expand the area the subject of native title to include Area C and D and for the Pedersens to obtain a perpetual lease for Primary Production Activity Purposes over all of the land the subject of the expanded native title determination, with the exception of Area A. | |
