This is the State of Queensland's second mining agreement under the 'Right to Negotiate' provisions of the Native Title Act 1993 (Cth). The agreement is between the Ewamian people, Union mining and the Queensland State Government.
Union applied for 16 mining leases between 1993 and 1996 over land around Georgetown and Forsayth in North Queensland. In April 1997 the Queensland Government issued notices of its intention to grant the 16 leases pursuant to the Native Title Act. In response to the notices the North Queensland Land Council lodged the Ewamian peoples' native title claim in June 1997. Agreement was reached between the parties assisted by a Native Title Tribunal mediator in November 1997.
The Ewamian people agreed to the Government granting the 16 mining leases to Union. The agreement provides for Ewamian people having a meaningful involvement in the project that will affect their traditional country. The agreement provides for the establishment of a liaison committee consisting of Ewamian and Union Mining representatives to review the progress of the project, a comprehensive regime for protection of Ewamian sites of significance and employment and training opportunities for Ewamian people.
Union also agreed to provide in principle support for Ewamian peoples' native title determination. The Ewamian representatives elected not to address the issue of compensation in this agreement because of Union's economic difficulties Associated with the slump in world gold prices. |
