The Aboriginal Heritage Act 2006 (Vic) repealed and replaced the Archeological and Aboriginal Relics Preservation Act 1972 (Vic). The Aboriginal Heritage Act provides the basis for a regime to recognise and protect areas and objects of significance to Aboriginal heritage in Victoria.
Detailed Information:
The Aboriginal Heritage Act 2006 (Vic) was enacted to revise and improve the legal and administrative arrangements providing for the protection of Aboriginal cultural heritage in Victoria.

Primary responsibility for the implementation of the legislation and the Aboriginal Heritage Regulations 2007 is allocated to the Aboriginal Affairs Division of the Department of Planning and Community Development.

The Act contains several arrangements to provide distinct roles for Aboriginal people in planning and decision-making pertaining to the protection and management of cultural heritage, including the establishment of a Victorian Aboriginal Heritage Council and Victorian Aboriginal Heritage Register (Part 9). The Act also establishes procedures for the identification of 'registered Aboriginal parties' to facilitate participation in decision-making and the management and protection of places and objects of major significance to Aboriginal heritage.

The legislation is cross-referenced to the Native Title Act 1993 (Cth) and the land use planning and development regime established by the Planning and Environment Act 1987 (Vic) and the Environment Effects Act 1978 (Vic).
