The ILUA area covers approximately 1,096 square kilometres of land and waters located south of Biloela, west of Monto and east of Taroom in the state of Queensland. The ILUA area is cited in the vicinity of Cracow, and falls within the jurisdiction of Banana Shire Council. The ILUA area covers the land and waters falling within the external boundaries of the Wulli Wulli People native title claim (Federal Court File No. QUD6006/2000). Upon the grant of an easement for the Surat Gladstone gas pipeline, the ILUA area will be reduced to the area covered by the easement. The ILUA area excludes any area falling within the external boundaries of the Iman People #2 native title claim (Federal Court File No. QUD6162/1998) and the Wakka Wakka People #2 native title claim (Federal Court File No. QUD6032/1999). | ||

The Surat Gladstone Pipeline (SGP) Wulli Wulli People ILUA was agreed between Surat Gladstone Pipeline Pty Ltd and the Wulli Wulli Applicants (being the registered native title claimants in the Wulli Wulli People native title claim, which was filed with the Federal Court of Australia under File No. QUD6006/2000). The purpose of this ILUA is to provide consent for the construction and operation of the Surat Gladstone gas pipeline. The Surat Gladstone Pipeline will be an underground high-pressure steel gas transmission pipeline delivering coal seam gas from the Surat Basin to a liquefied natural gas plant in Gladstone. | ||

Consent to future acts The parties to this ILUA consent to the doing of certain acts by Surat Gladstone Pty Ltd for the purpose of constructing, operating, maintaining using or repairing the Surat Gladstone Pipeline. These acts include, but are not limited to: Right to negotiate provisions The parties agree that the right to negotiate provisions of the Native Title Act 1993 (Cth) do not apply to any future acts to which consent is given under this ILUA. Native Title in the ILUA Area The Surat Gladstone Pipeline is intended to extend north-west from Dalby to Chinchilla and then north through the Banana Shire to Gladstone. It will therefore run through the claim area of the Wulli Wulli People native title claim (Federal Court File No. QUD6006/2000). Under the Native Title Act 1993 (Cth), any activity that may affect native title rights in such a way is defined as a 'future act' and must comply with the future act provisions of the Act in order to be valid. This ILUA entitles the parties to circumvent those provisions. This ILUA is one of a series of ILUAs entered into between Surat Gladstone Pipeline Pty Ltd and various native title claimants to enable it to proceed with the pipeline project. |
