The Heads of Agreement was reached between the Byron Bay Shire Council and the Arakwal people through the Arakwal Aboriginal Corporation. The agreement represented the first substantial agreement between a local shire council and native title applicants in New South Wales. |
Detailed Information:
The Heads of Agreement sets out a framework for ongoing consultations between the Council and the Arakwal people and resolves a number of issues on priority developments in the area. The agreement formalises the Byron Shire Council Aboriginal Consultative Committee, comprising representatives of the Council and the Arakwal community. The Committee's job is to make recommendations to Council on a planning strategy for Byron Shire which takes into account the concerns of the Arakwal community and on specific development proposals.
This Heads of Agreement follows on from two prior agreements, one reached in 1997 between the Arakwal people and the State Government of New South Wales regarding a new State Recreation Area in the Byron Bay area, and one also reached in 1997 between the Arakwal people and the Byron Shire Council with the Shire recognising the Arakwal as the traditional owners of the region. The Heads of Agreement precedes the 2001 Native Title Consent Determination involving the Arakwal People of the Bunjalung Nation and the NSW Aboriginal Land Council, NSW Minister for Land and Water Conservation and Telstra Limited (FC: NG6088/98; NNTT: NC97/36), and the 2001 Arakwal Indigenous Land Use Agreement.
