The area covered by this Indigenous Land Use Agreement (ILUA) comprises approximately 8.6 hectares of land within Crown Allotment 2, Section 14, in the township of Charlton in the state of Victoria. The ILUA area is located adjacent to Watson Street and Back St Arnaud Road. It falls within the jurisdiction of the Buloke Shire Council.
Legal Status: Registered with the National Native Title Tribunal on the Register of Indigenous Land Use Agreements on 31 March 2011. This is an authorised Area Agreement under the Native Title Act 1993 (Cth).

This Indigenous Land Use Agreement (ILUA) was agreed between the Charlton Harness Racing Club Incorporated and Gary John Murray and others on behalf of the Dja Dja Wurrung People on 18 October 2010. The purpose of this ILUA is to provide consent for the doing of a series of future acts in relation to the construction and operation of a training complex for harness racing in the ILUA area.

The Charlton Harness Racing Club project

This ILUA relates to a development project that will involve the expansion of the Charlton Harness Racing Club in regional Victoria. The project consists of the construction and operation of a harness racing training complex in the ILUA area.

Consent to future acts

The parties to this ILUA give their consent to the doing of certain future acts with respect to the ILUA area, and agree that the doing of these acts shall be valid. These acts include:

  • the grant of a lease to the developer by the State of Victoria pursuant to the Crown Land (Reserves) Act 1978 (Vic), provided that this lease complies with a pre-determined format set out in Schedule C;

  • any renewal or variation of the lease by the State of Victoria, or the grant of any other lease over the ILUA area by the State to the developer in the future;

  • the completion of the project by the developer on the ILUA area;

  • the use of the ILUA area by the developer for the construction and operation of a training complex for harness racing;

  • the grant of any infrastructure or land tenure access titles, approvals, consents, conditions and rights that may be required by the developer;

  • the removal of trees or other vegetation by the developer in the ILUA area; and

  • the construction of a training complex and surrounding tree plantations, as outlined in the project plans.


  • Background to this ILUA

    This agreement constitutes the 500th ILUA to be registered with the National Native Title Tribunal. In a joint media release with Families, Housing, Community Services and Indigenous Affairs Minister Jenny Macklin, Attorney-General Robert McClelland has described the agreement as 'another significant milestone in the history of native title in Australia.'

    The area covered by this ILUA is subject to a registered native title claimant application by the Dja Dja Wurrung Peoples, whose claim was filed with the Federal Court of Australia as proceeding VID6001/00 on 19 July 2000. This claim remains active, and is now in mediation.
