Summary Information:
The Delamere Indigenous Land Use Agreement (ILUA) was agreed between:
- the Commonwealth of Australia; and
- Jessie Brown, Neville Brown, Nina Brumby and Smiler Larrgut; and
- William ('Bill') Harney on behalf of the Wardaman Group, and Alan Young and William ('Bill') Harney on behalf of the Wardaman, Liyi, Yingawurnarri and Narrwan groups, and Jessie Brown on behalf of the Wardaman, Jalalabayin, Wubalawun and Daly Waters families groups; and
- the Northern Land Council.

The purpose of this ILUA is to provide consent to a range of future acts relating to Delamere in the Northern Territory which is partly owned by the Department of Defence and partly under a pastoral lease.

Contents of Agreement

Term and effect of Agreement
Clause 3(1) of the Agreement states that the ILUA will only come into effect if it is registered.
Clause 3(5)of the Agreement states that the ILUA is in effect from the Commencement Date (which is unknown) until the date when the Defence performs certain obligations. These obligations are listed in clauses 7.1(a) and 7.1(b)of the Agreement. However, the contents of these clauses is unknown as they were not released by the National Native Title Tribunal.

Future Acts
Consent is given for a number of future acts to be performed. These acts are detailed in clause 2.2(x) of the agreement. The Acts largely relate to transfering and surrendering certain interests in land. They also relate to the Department of Defence's continued use and occupation of the land.

Background to the Agreement
The agreement is with the Department of Defence. The Department of Defence is a major landowner with approximately 3 million hectares across the country. (Parliament of Australia, Joint Committee, Native Title and the Aboriginal and Torres Strait Islander Land Fund Committee, 2003)
