Summary Information:
This Indigenous Land Use Agreement (ILUA) was agreed between the State of Queensland, Annie Wonga, Andrew Miller, Mark Wilson, Adrian Murray and Lilian Willis (Senior), Wanyurr Majay Aboriginal Corporation and the Wet Tropic Management Authority.

The purpose of this ILUA is to provide for the management of the Wooroonooran National Park.

Content of the ILUA

Commencement and Expiry
The ILUA commences on the date which the last party signs the agreement, with the exception of Clause 5 which commences on the date of determination of native title. A determination of native title occured in August 2011 in the matter of Wonga on behalf of the Wanyurr Majay People v State of Queensland [2011] FCA 1055.

The ILUA will expire if there is a determination by the Federal Court of Australia that native title does not exist in the ILUA area or if a regulation commences which regulates the native title rights and interests in relation to the part of the ILUA.

Background to the ILUA
The Wanyurr Majay People first lodged an application for native title in the Federal Court of Australia in 2008. Their native title was recognised in a consent determination on the 31st of August 2011 (Wonga on behalf of the Wanyurr Majay People v State of Queensland [2011] FCA 1055). Their native title was recognised over an area in the vicinity of Mt Bellenden Ker which covers part of the Wooroonooran National Park and surrounding areas. The consent determination recognised the rights of the Wanyurr Majay people to use the land for hunting, fishing and gathering purposes and to conduct ceremonies and carry out cultural activities.

This particular ILUA is one of two ILUAs that arose out of the consent determination. The other is with the Cairns Regional Council (National Native Title Tribunal number QI2011/037).
